Terms & Conditions

These Terms & Conditions govern all orders, artwork submissions, and business transactions between Brand Studio Pty Ltd (“we”, “our”, “us”) and the client (“you”). By placing an order or approving artwork, you agree to these terms.

Orders & Payments

All orders are confirmed once full payment or valid proof of payment has been received.

Production will not begin until both payment and final artwork approval have been completed.

Quotations are valid for 7 days from the date of issue unless otherwise stated.

Prices are subject to change without prior notice if supplier costs or material prices fluctuate.

We reserve the right to decline any order if specifications are unclear or cannot be fulfilled.

Proofs & Approvals

We provide digital proofs for client approval prior to production.

By approving a proof, you accept full responsibility for layout, spelling, grammar, colours, and design accuracy.

Any changes requested after proof approval may cause production delays or incur additional charges.

Once artwork has been approved and production begins, no further alterations can be made.

Cancellations & Changes

Orders cancelled after artwork approval may be subject to a cancellation fee or may not be refundable if production has already started.

If an order is cancelled before production, a 10–20% handling fee may apply to cover administrative and processing costs.

Repeated artwork revisions after approval may incur additional layout or design fees.

Delivery & Returns

We currently operate only within South Africa.

Delivery times quoted are estimates and may vary depending on workload, courier schedules, or supply delays.

You will be notified once your order has been dispatched.

It is your responsibility to inspect all goods upon receipt.

Any shortages, damages, or incorrect items must be reported within 48 hours of delivery.

Due to the nature of custom-branded and made-to-order products, returns are only accepted in the event of manufacturing or printing defects.

Orders that have already entered production, been branded, or collected cannot be returned or refunded.

Liability & Colour Variations

We make every effort to ensure accuracy and consistency in all production processes.

However, minor variations in colour, texture, or finish may occur due to different materials, printers, or screens.

We cannot be held liable for errors present in client-approved artwork.

Once goods leave our premises, we are not responsible for any damages incurred during shipping unless reported immediately.

Intellectual Property

Client-supplied artwork and logos are used solely for the purpose of fulfilling your order.

By submitting artwork or branding material, you confirm that you own the rights to that content or have obtained permission to use it.

We reserve the right to display completed products in our portfolio, social media, or marketing materials unless otherwise requested in writing.

Force Majeure

We will not be liable for any failure or delay in performance due to circumstances beyond our reasonable control — including but not limited to: natural disasters, labour disputes, supplier delays, power outages, or transportation disruptions.

Governing Law

These Terms & Conditions are governed by the laws of the Republic of South Africa, including the Consumer Protection Act (CPA) and the Electronic Communications and Transactions Act (ECTA).

Severability & Notices

If any part of these Terms is found invalid or unenforceable, the remaining clauses will continue in full effect.

All formal communications or notices must be made in writing and sent to the contact details provided on our website.
